Terms of service
These terms govern the use of this website and set out the general conditions under which Diqoded works. Every project is governed by its own written proposal or contract, which takes precedence over these terms.

01Who we are
Diqoded is the trade name of a self-employed professional (autónomo) registered in Spain and based in the Región de Murcia. Contact: contact@diqoded.com.
Identification and billing details (full legal name, tax identification number and fiscal address) are not published on this website. They are included in every proposal, contract and invoice, and are provided on request to clients, prospective clients and public authorities with a legitimate interest.
02Scope of these terms
These terms apply to the use of this website. The provision of any service is governed by an individual written agreement — a signed contract or an accepted written proposal — between Diqoded and the client. If anything in these terms conflicts with that agreement, the agreement prevails.
Information on this website, including prices, timelines and descriptions of services, is general and indicative. It is not a binding offer. Prices and conditions become binding only when they are set out in a written proposal or contract accepted by both parties.
03Projects and contracts
The scope, deliverables, timeline, price, payment terms and acceptance criteria of each project are defined in its written agreement. Anything not expressly listed there is outside the scope of the project.
Changes to the scope, additional work or new requirements must be agreed in writing and may change the price and the timeline.
Timelines depend on the client providing the information, content, access and feedback agreed in the contract on time. Delays on the client side extend the timeline accordingly.
04Client responsibilities
The client is responsible for:
- providing accurate, complete and lawful information, content and materials, and holding all the rights needed to use them (texts, images, logos, trademarks, data);
- the legal compliance of its own business and website, including licences, permits, sector regulations, privacy and cookie notices, consent of its customers and its obligations as data controller under the GDPR;
- reviewing and approving deliverables, texts and automated outputs before they are published or used;
- keeping its own accounts, passwords and access credentials secure, and keeping its own backups of business data;
- the accounts and contracts it holds with third-party providers (hosting, domains, payment processors, messaging platforms, AI providers and similar), including their fees and terms.
05Risk disclaimer
We aim to deliver accurate and dependable work, but software, websites and automated systems that rely on the internet and on third-party services inherently involve certain risks. Diqoded is not liable for losses or damages resulting from:
- outages, errors, security incidents, changes of features, pricing or terms, or discontinuation of third-party services and platforms, such as hosting and domain providers, payment processors, Google, Meta and WhatsApp, AI model providers, CRMs and other APIs;
- search engine or AI assistant rankings, traffic, enquiries, leads or sales: these depend on factors outside our control, and no specific commercial result is guaranteed;
- outputs of AI and automation tools, which may be incomplete or inaccurate and must be reviewed by the client before being relied upon or sent to third parties;
- content, data, materials or instructions supplied by the client or by third parties on its behalf;
- pre-existing or hidden issues in existing websites, code, data, servers or systems that were not built by Diqoded;
- changes, updates or interventions made after delivery by the client or by third parties, or use of the deliverables outside their intended purpose;
- events beyond our reasonable control (force majeure).
Clients are encouraged to carry out their own due diligence, including checking any licences, permits, consents or regulatory requirements that their project or business may be subject to.
06No warranties
This website and its content are provided "as is" and "as available". We do not warrant that the website will be uninterrupted, error-free or free of harmful components. Articles and other content are for general information only and do not constitute legal, tax, financial or other professional advice.
Any warranty for a specific project, including bug-fixing periods, is limited to what is expressly stated in its written agreement.
07Limitation of liability
To the maximum extent permitted by applicable law:
- Diqoded is not liable for any indirect, incidental, special or consequential damages, including loss of profits, revenue, business, goodwill, data or opportunities, or business interruption;
- the total liability of Diqoded for any claim arising from a service is limited to the fees actually paid by the client for the specific service giving rise to the claim in the three (3) months before the event that caused it;
- any claim must be notified in writing within a reasonable time after the client becomes aware of it, and in any case within six (6) months.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as liability for wilful misconduct or gross negligence, or the statutory rights of consumers.
08Payments
Fees, payment schedule and methods are set out in each written agreement. If a payment is overdue, Diqoded may suspend work, deliveries and any services under its control until it is settled, and timelines are extended accordingly. For business clients, late payments accrue interest and recovery costs under Spanish Law 3/2004 on late payment in commercial transactions.
09Intellectual property
All content on this website — texts, design, graphics, layout and code — belongs to Diqoded or its licensors and may not be copied, reused or distributed without written permission.
Ownership of or rights to project deliverables are transferred to the client as set out in its written agreement and only after full payment. Diqoded keeps the rights to its pre-existing tools, components and know-how, and open-source software remains subject to its own licences.
Unless agreed otherwise in writing, Diqoded may mention the client’s name and show the completed project in its portfolio, without disclosing confidential information.
10Confidentiality
Both parties keep confidential any non-public business or technical information shared during a project, unless agreed otherwise in writing or required by law. This obligation continues after the project ends.
11Use of this website
This website is intended for users aged 18 or over. You agree not to misuse it, including attempting to gain unauthorised access, disrupting its operation or submitting false or unlawful information through its forms. Links to third-party websites are provided for convenience; we are not responsible for their content or practices.
12Changes to these terms
We may update these terms at any time. The current version is always published on this page with its date. Changes do not affect projects already governed by a signed agreement.
13Governing law and jurisdiction
These terms are governed by Spanish law. The parties will first try to resolve any dispute amicably. For business clients, the courts of Murcia (Spain) have jurisdiction. Consumers keep the right to bring proceedings before the courts of their place of residence, as provided by law.
